These Terms and Conditions of Use ("Terms") are legally binding. Please read them carefully before using this website or contacting us. By using the website, you accept these Terms.
1. General provisions
This website is owned and operated by Forrest Personalised Nutrition ("we", "us", "our"), a Swiss sole proprietorship based in Vaud, Switzerland. We maintain and host our website on a reputable platform and take reasonable care to keep it available and secure.
These Terms may be updated at any time. The version published on our website is always the current version. Where we make a significant change, we will draw attention to it on the website.
2. Nature of our services
Forrest Personalised Nutrition provides personalised nutrition consulting services, delivered online and in person, focused on gut health and hormonal and perimenopausal health. We work with each client individually, building a personalised programme rather than applying a one-size-fits-all approach.
Important — non-medical service: Our services are educational and supportive in nature and do not constitute medical advice, diagnosis, or treatment. We are not medical doctors and our services are not a substitute for medical care. If you have, or suspect you have, a medical condition, or in an emergency, contact your doctor or emergency services immediately. With your consent, we may coordinate with your treating healthcare providers.
The degree of benefit you experience can vary between individuals, even where similar programmes are followed for similar concerns. We do not guarantee any particular outcome.
Any consulting engagement with us is governed by a separate client agreement, which you will be asked to read and accept before work begins. In the event of any conflict between these Terms and the client agreement, the client agreement prevails for the consulting relationship.
3. Booking, cancellation, and rescheduling
Consultations are booked via our online booking system (currently Google Calendar). The full booking, cancellation, rescheduling, no-show, and fee terms are set out in the client agreement.
Summary: cancellations or rescheduling requests made with less than 24 hours’ notice may be charged at the full fee; no-shows are charged in full. Confirm the current terms at the time of booking.
We do not currently process payments online. Payment terms are communicated to you directly at the time of booking. If this changes, these Terms and our Privacy Policy will be updated.
4. Your responsibilities when using the website
You agree to use the website lawfully and not to misuse it or attempt to gain unauthorised access.
You agree not to submit content that is unlawful, defamatory, obscene, or otherwise harmful or inappropriate.
Advice we publish is general in nature. It is personal to no one and is not a substitute for individualised advice. Please contact us before acting on anything that may affect your health.
Responsibilities that apply during a consulting engagement (for example, disclosing medical conditions, medications, and supplements) are set out in the client agreement.
5. Intellectual property
All text, images, designs, graphics, logos, and other content on this website are owned by [Business Name], unless otherwise attributed, and are protected under Swiss and international copyright and trademark law. You may not republish, reproduce, or reuse any content from this site elsewhere, including on social media, without our prior written consent.
Our business name and logo are trademarks of [Business Name]. Any personalised programme we deliver to a client is for that client’s personal use only and may not be shared, resold, or published without our written consent.
6. Your communications and submissions
Communications you send us through our contact form, email, or social media pages are handled in line with our Privacy Policy. They are not treated as legally privileged or confidential in the sense of attorney-client privilege, but your personal data is processed securely and only as described in the Privacy Policy.
To protect your privacy, please avoid sending detailed health or medical information by open email or social media. Where health information is needed, we will provide a secure intake route.
We will not publish or reuse anything you send us, such as a testimonial, without asking for your permission first.
7. Third-party links
Our website may contain links to third-party websites for convenience. We are not responsible for the content, accuracy, or privacy practices of any external site, and following such a link is done at your own risk. We do not endorse linked sites or any health claims made on them.
8. Disclaimers and limitation of liability
This website and related materials are provided "as is", for informational and guidance purposes, without warranties of any kind, express or implied, to the fullest extent permitted by Swiss law.
To the fullest extent permitted by Swiss law, our total aggregate liability for any claim arising out of or relating to this website or our services is limited, save in respect of liability that cannot be excluded or limited under Swiss law (including liability for intent, gross negligence, and death or personal injury caused by our negligence). We do not guarantee any specific health or other outcome from our services.
9. Force majeure
We are not liable for any delay or failure to perform where this is caused by circumstances beyond our reasonable control, including illness, accidents, or disruptions to third-party services we rely on. We will notify affected clients as soon as reasonably possible and resume normal service when we are able.
10. Termination and suspension
We may suspend or terminate access to the website, or decline or end a working relationship, at our discretion, including where we believe these Terms or the client agreement have been violated, or where a client’s conduct or disclosed needs indicate that medical or emergency care is required that we cannot provide. Subject to applicable law, we will give reasons where reasonable to do so.
11. Minors
Our services are intended for adults. We do not knowingly provide services to anyone under 18 without the consent of a parent or legal guardian. Where a minor is accepted as a client, the engagement is subject to additional consent and data-protection conditions set out in the client agreement.
12. Complaints
If you have a complaint, please contact us by email at infor@forrest-nutrition.com. We will acknowledge complaints promptly and aim to respond in writing within 14 working days. If you are not satisfied with our response, you may refer the matter to the relevant Swiss cantonal consumer-protection authority, or to the data-protection authority on data-protection matters.
13. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forrest Personalised Nutrition regarding your use of this website. Where you enter into a separate client agreement with us for consulting services, that agreement governs the consulting relationship and prevails in the event of any conflict.
14. Governing law and jurisdiction
These Terms are governed by and construed in accordance with Swiss law. Any dispute arising out of or relating to these Terms or the website is subject to the jurisdiction of the courts of Vaud, Switzerland, subject to any mandatory consumer-protection rights that apply to you under the law of your country of residence.
Before any court proceedings, the parties will first attempt in good faith to resolve the dispute by direct discussion and, if that fails, by mediation under the rules of a Swiss mediation body. Nothing in this clause limits your right to seek interim or injunctive relief, or to exercise mandatory consumer rights in your home jurisdiction where the law so provides.
15. Severability
If any part of these Terms is found to be unlawful or unenforceable, all other provisions will remain in full force and effect.
